thanks a lot for all the information i got from this forums, they really helped me a lot..
but honestly my H1b stamping went through without any hastle... it just took 2 minutes..
well here are few details of the things happened on the day and the next day, my interview was on 29th of august at 10 am and i reached the consulate in toronto around 8 30 am in the morning, they allowed me into the consulate and there are two ladies who checked my 797 and 156 and 157 along with scotia receipts and they kept the docs in a blue file and gave it back to me
than i went into the the main room and waited inside where the actual stuff happens, at first i went directly into a line ( window 6 or 7 or 8) and i had given the blue file in which i have the documents and they had checked the docs and asked me to sit and i will be called..
after around 45 minutes i was called(window 1) and they had taken my finger prints and again asked me to wait and i will be called
then after around 1 hour i was called(window 4) and this is the actual interview..
the officer looked at my papers and asked me where my spouse is working and i told her about that.. and than she asked me on what basis i got this job and i told her that i got around 5 years exp as an IT consultant.
than she said its fine and she is granting me my H1 visa and i can collect it on 31st..
than the interesting thing happened..
she canceled my H4 without prejudice and said she cant keep two H visas in my passport.
than i asked her that i am not a resident of canada and i have to leave to US and wether i can enter into US on the new H1..
than she said unfortunately i might not enter on the new H1 before sept 21st (she also said that i can try my luck at the border and sometimes the border officers will allow) and she thought around few seconds and suggested me to apply for a new b1/b2 (visitor) visa and she will approve the visa for me and i can enter US using my B1/B2 if the border officer wont allow me to enter using my H1 because i am entering US before sep 21st..
so she gave me a 221g which allows me to go to the consulate without an appointment and she asked me to bring a new 156 and scotia bank receipt for 100 dollars for my B1/B2..
so again i went to the consulate on 30th of august and submitted my papers.
on 31st of august at 3 pm i got my passport back with both my H1 and B1/B2.. i really felt so good the way i was treated in the consulate and the way the officer helped me..
than at the border i was thinking whether the border office will have any queries.. and i was getting ready to face all the queries..(as you know i am on a I94 with my H4 and i have to change it to H1 I94 or B1/B2 I94).
but again gods are on my side
i told to the border office that i crossed the border on my H4 and now i am entering US with my H1.
than he asked me to sit for a while until he processed my new I94 with H1 and i have to pay 6 dollars for that.
thats it... after 3 minutes i got my I94 with H1 and i paid the fees..
So thats it friends... i m back home and thanked god a million times..
